Deodorization as Fraud
Deodorization of degraded frying oil is the chemical equivalent of severing smoke detectors before setting a fire. It removes the evidence of the crime while leaving the criminal.
The Two Forms of Fraud
Form 1 — Industrial Deodorization of Used Oil
Commercial frying oils undergo industrial deodorization — steam distillation under vacuum at 220–270°C — at two points in their lifecycle:
Legitimate first application: Initial refinery deodorization removes volatile compounds from freshly extracted oil. This is a manufacturing step, not quality fraud, though it does generate trans fatty acid isomers and process-derived oxidation products.
Fraudulent second application: Deodorization applied to used, degraded commercial frying oil to restore sensory characteristics. The result:
- Smells fresh ✓
- Appears fresh (lighter color) ✓
- Tests acceptable for free fatty acid content ✓
- Still contains full burden of non-volatile oxidized compounds (4-HNE precursors, OXLAMs, TPC) ✓
The oil is then sold or re-used. Restaurant operators purchasing deodorized used oil at reduced cost may be unaware it has been degraded. The consumer receives no disclosure.
Form 2 — Onsite Oil Regeneration Services
A commercial market exists for onsite oil regeneration:
- Activated carbon treatment — removes color bodies and odorous compounds, does NOT reduce TPC
- Antioxidant injection — suppresses rancidity detection, does not address existing oxidation products
- Nitrogen blanketing + heat treatment — volatilizes off-flavors, non-volatile toxicants remain
- Re-blending with fresh oil — dilutes sensory detectability, may not bring TPC below threshold
These systems are sold with the explicit promise of dramatically extended oil life. Some are marketed as allowing indefinite oil use with continuous treatment.
The distinction between legitimate and fraudulent onsite treatment is analytically precise:
- Legitimate: Magnesium silicate, food-grade bentonite clay, diatomaceous earth — physically adsorb and remove polar compounds, genuinely reduce TPC. Should be encouraged.
- Fraudulent: Any treatment that restores sensory presentation without reducing TPC.
The Statutory Framework
Section 402(a)(1) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. § 342): "A food shall be deemed to be adulterated if it bears or contains any poisonous or deleterious substance which may render it injurious to health."
The non-volatile oxidized lipid fraction (4-HNE precursors, OXLAMs, TPC) in deodorized end-of-life frying oil:
- Is a "poisonous or deleterious substance" — documented in peer-reviewed literature
- "May render it injurious to health" — the mechanisms are fully characterized
- Has been specifically concealed from detection by the deodorization or regeneration process
This meets the statutory definition of adulteration.
The Evolutionary Sensory Argument
The human olfactory system can detect:
- Hexanal at ~4.5 ppb
- (E)-2-nonenal at ~0.08 ppb (the "old fat" smell)
- (E,E)-2,4-decadienal at ~0.07 ppb
These detection thresholds are near the physical limits of aerosol detection — evidence of strong evolutionary selective pressure to detect these specific compounds. They evolved as precursor signals to the non-volatile toxic fraction — generated earlier in the oxidation cascade and volatile where the toxic fraction is not.
Deodorization neutralizes this evolved detection system with precision. It is not coincidentally masking a warning signal — it is specifically targeting the compounds the human sensory system was calibrated to detect.

The Regulatory Philosophy Argument
Whatever else the FDA regulates, it should not permit:
- The targeted neutralization of evolved consumer safety mechanisms
- Without replacing them with an equivalent analytical protection
Deodorization destroys the first protection. The absence of TPC standards eliminates the second. The consumer is left with no detection mechanism for a confirmed biological hazard.
